This website, modumoss.com, is operated by ModuMoss (“ModuMoss,” “we,” “us,” or “our”). We offer this website, including all information, tools, products and services available from it (the “Services”), to you on the condition that you accept these Terms of Service (“Terms”), along with our Privacy Policy, Return & Refund Policy and any other policies linked on this site.

By visiting the site or buying from us, you agree to these Terms. If you do not agree, please do not use the Services. We may update these Terms at any time by posting a new version on this page; continuing to use the Services after an update means you accept the changes. Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell to you.

1. Eligibility and Use of the Store

By agreeing to these Terms, you confirm that you are at least the age of majority where you live, or that you have that age and have given permission for any minor in your care to use the site. You may not use our products or the Services for any illegal or unauthorized purpose, or violate any laws in your jurisdiction, including intellectual property laws. You must not upload or transmit viruses or any other harmful code. Breaking these Terms may result in immediate termination of your access to the Services.

2. General Conditions

We may refuse service to anyone, for any lawful reason, at any time. Information you send us (other than payment card details, which are always encrypted) may travel unencrypted across networks. You may not copy, reproduce, resell or exploit any part of the Services, including our product designs, photos and written content, without our written permission. Section headings are for convenience only and do not change the meaning of these Terms.

3. Accuracy of Information

We work to keep the information on this site accurate and current, but we do not guarantee that it is complete, accurate or up to date. Content on this site, including plant care guidance, is provided for general information only; rely on it at your own risk. We may change site content at any time without notice and are not obligated to update it.

4. Changes to Products, Services and Prices

Prices and product specifications may change without notice. We may modify, suspend or discontinue any product or part of the Services at any time. We are not liable to you or anyone else for any price change, modification, suspension or discontinuation.

5. Products

Made to order. Our products are designed and 3D printed to order in Las Vegas, Nevada. Estimated production and shipping times are shown on our product pages and are estimates, not guarantees.

Natural variation. Because each item is printed individually, small variations in color, layer lines, surface texture and dimensions are a normal characteristic of the product and are not defects. We display colors as accurately as we can, but we cannot guarantee that your screen shows them exactly.

Intended use. Our moss poles, pots and accessories are designed to support indoor plants. They are not designed to bear weight other than a plant and its growing medium, and are not toys. Use appropriate bracing for tall or heavy plants. We are not responsible for the health or growth of your plants.

We may limit quantities or sales of any product to any person, region or jurisdiction. Returns and exchanges are handled under our Return & Refund Policy.

6. Orders, Billing and Account Information

We may refuse or cancel any order, limit quantities per person, household or order, or decline orders that appear to be placed by resellers or distributors. If we change or cancel an order, we will try to contact you using the email, billing address or phone number you provided. You agree to give us current, complete and accurate purchase and account information and to keep it up to date.

7. Third-Party Tools and Links

We may give you access to third-party tools, apps or websites that we do not monitor or control. You use them “as is,” at your own risk, and subject to the third party’s own terms. We are not responsible for third-party content, products or services, and any complaints about them should be directed to that third party.

8. Your Submissions

If you send us reviews, photos, ideas, suggestions or other material (“Submissions”), you grant us a non-exclusive, royalty-free, perpetual license to use, edit, publish and distribute them in any medium, without compensation to you. You confirm that your Submissions do not violate anyone’s rights and are not unlawful, abusive or misleading. We may, but are not required to, remove any Submission we find objectionable.

9. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy.

10. Errors and Omissions

The site may occasionally contain typographical errors, inaccuracies or omissions in product descriptions, pricing, promotions, availability or shipping times. We may correct them, and change or cancel orders affected by them, at any time without prior notice, including after you have submitted an order.

11. Prohibited Uses

You may not use the site or its content to: break any law or encourage others to; infringe our or anyone else’s intellectual property; harass, abuse, defame or discriminate; submit false or misleading information; upload malicious code; collect other users’ personal information; send spam or phish; scrape or crawl the site for unlawful purposes; or interfere with the site’s security. We may terminate your use of the Services for violating any of these restrictions.

12. Disclaimer of Warranties; Limitation of Liability

Except as expressly stated in our Return & Refund Policy, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not guarantee that the site will be uninterrupted, secure or error-free.

To the fullest extent permitted by law, ModuMoss and its owners, employees, contractors and suppliers are not liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, lost data, or damage to plants or property, arising from your use of the Services or any product. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless ModuMoss and its owners, employees, contractors and suppliers from any claim or demand, including reasonable attorneys’ fees, made by a third party because of your breach of these Terms or your violation of any law or the rights of a third party.

14. Severability

If any part of these Terms is found unlawful or unenforceable, that part will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect.

15. Termination

These Terms remain in effect until terminated by you or us. You may end them at any time by no longer using the Services. We may end them, or your access to the Services, at any time if we believe you have failed to comply with them. Obligations and liabilities incurred before termination survive it.

16. Entire Agreement

These Terms, together with the policies posted on this site, are the entire agreement between you and ModuMoss about the Services and replace any earlier agreements or communications. Our failure to enforce any right or provision is not a waiver of it. Any ambiguity will not be interpreted against the drafter.

17. Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in Clark County, Nevada.
